To: All individuals who filed a chapter 13 bankruptcy in the United States Bankruptcy Court for the Southern District of Ohio on or after January 1, 2012, who had a principal residential mortgage subject to Rule 3002.1(a) of the Federal Rules of Bankruptcy Procedure, where the mortgage was held or serviced by NewRez LLC dba Shellpoint Mortgage Servicing at any time during the bankruptcy case, up to and including the date of the Preliminary Approval Order, and for whom any claimed Rule 3002.1 violation was not adjudicated or settled in their chapter 13 case.

Settlement Overview

  • A proposed settlement has been reached in a class action titled Morningstar v. NewRez, between Debtors Monica M. Morningstar and Timothy L. Bentley, on behalf of themselves and the Settlement Class, and NewRez LLC dba Shellpoint Mortgage Servicing (“Shellpoint”), pending in the United States Bankruptcy Court for the Southern District of Ohio.
  • The Settlement Fund is $325,000.00, with a possible increase to $350,000.00 if Participating Settlement Class Members would otherwise receive less than $335 per claim. The Fund will be used to pay payments to Settlement Class Members who submit approved claims (up to $335 each, subject to pro rata adjustment), attorneys’ fees and costs, Settlement Administrator costs, and Service Awards to the Class Representatives of up to $3,000 each.
  • Officers, board members, trustees, and directors of Creditor, their legal representatives, heirs, successors, or assigns, and anyone who opts out are excluded from the Settlement Class.
  • To receive a payment, you must submit a Claim Form by the Claims Deadline, which is 75 days after the Notice Deadline, October 22, 2026. The Claim Form is included with the Settlement Class Notice.
